ELEXIM, a.s. processes your personal data based on legitimate interest or when necessary to fulfill a contract with you regarding the sale of goods (or to take steps at your request prior to entering into such a contract). The company also processes your personal data when required to fulfill its public law obligations.

Legal Basis for Processing Personal Data The legal basis for processing your personal data is that such processing is necessary: for the purposes of the legitimate interests pursued by the controller or a third party within the meaning of Article 6(1)(f) of Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR); or for the performance of a contract between you and the controller or to take steps at your request prior to entering into such a contract within the meaning of Article 6(1)(b) of the GDPR; or for compliance with a legal obligation to which the controller is subject within the meaning of Article 6(1)(c) of the GDPR, particularly obligations imposed by generally binding legal regulations, especially Act No. 235/2004 Coll., on Value Added Tax, Act No. 586/1992 Coll., on Income Taxes, and Act No. 563/1991 Coll., on Accounting, all as amended.
Scope and Purpose of Personal
Data Processing With your consent, the controller processes the following data: name and surname, company, email, and telephone number.
The purpose of processing your personal data is the legitimate interest of the controller or a third party in responding to your request for a quote, inquiry, or article/product/service comment; or the performance of a contract between you and the controller, including the delivery of goods and addressing warranty claims, or steps taken prior to entering such a contract, and compliance with related public law obligations.
The controller does not engage in automated individual decision-making as defined in Article 22 of the GDPR.
Retention Period for Personal Data
Your personal data will be processed for the duration of the contractual rights and obligations and further for the period required for archiving under applicable legal regulations, but no longer than the period defined by those regulations, or for a maximum of 3 years.
Other Recipients of Personal Data
Other recipients of your personal data include shipping companies and other entities involved in the delivery of goods or services, as well as technical service providers involved in the operation of the e-shop, including software operation and data storage. Recipients of your personal data processed to fulfill legal obligations may also include tax authorities or other relevant government bodies where required by law. The controller does not intend to transfer your personal data to a third country (outside the EU) or an international organization.
Data Subject Rights
Under the conditions set by the GDPR, you have the right to request access to your personal data, the right to rectification or erasure, the right to restrict processing, the right to object to processing, and the right to data portability.
If you believe that the processing of your personal data has violated or is violating the GDPR, you have the right to lodge a complaint with a supervisory authority.
You are not obliged to provide your personal data. However, the provision of your personal data is a necessary requirement for concluding and fulfilling a contract, and without providing your personal data, it is not possible to conclude or fulfill such a contract.
